GENERAL CONDITIONS
GENERAL CONDITIONS FOR AGENCY SERVICES IN REAL ESTATE BUSINESS BY THE COMPANY ADUT NEPREMIČNINE - ROK, BLED, D.O.O.
UNDER THE GIVEN CONDITIONS THE WORDS HAVE THE FOLLOWING MEANING:

Agent: the company ADUT nepremičnine - ROK, Bled, d.o.o., Črtomirova ulica 32, 4260 Bled
Commissioner/Principal: a person or a company who draws an agency agreement with the Estate Agent
Agency agreement: means a written contract concerning real estate agency where the real estate agent promises to endeavour to find third party customers for negotiation regarding drawing of a certain contract subject to which is a real estate and if the contract is draw the Commissioner/Principal promises to pay the Real Estate Agent for agency services.
PAYMENT FOR AGENCY SERVICES (COMMISSION)

Payment for agency in real estate (commission) covers the expenses that occur in business by making contracts for Commissioner/Principal, examining the state of a real estate and negotiations and preparations for drawing legal businesses which are necessary for drawing a legally bound contract for a specific real estate, that is:
1. in sale / in purchase of a real estate:
- Drawing a contract on Commissioning a Real Estate Agent;
- Passing the information on market situation information relevant for determination of a price of a real estate, on the regulations relative for the drawing of a contract on Commissioning a Real Estate Agent, on the amount of due taxes for the clients and on Notary Public's rates, onto the Commissioner/Principal and to a third party,
- Establishing the legal state of a real estate by obtaining document regarding the specific real estate (extract of Land Registration), contracts (if the real estate has not yet been registered in the Land Registration) and similar;
- Establishing the actual status of a real estate;
- Advertising of a real estate in media or in any other way and to an extend and a manner determined by the agent;
- Viewing of a real estate after the signing of the Contract on Commissioning a Real Estate Agent;
- Informing the Commissioner/Principal of the real estate and introduction to third party;
- Presence at the viewing of a real estate by the Commissioner/Principal;
- Informing a Commissioner/Principal with the established legal and actual state of the real estate and give reliable warning of established flaws and defects;
- Cooperation in negotiations in order to conclude the business;
- Drafting of a contract by a university graduated lawyer; written warnings, notices, confirmations;
- Telephone communications with clients.
If the Commissioner/Principal pays the commission in time the Agent shall offer the following services free of charge:
- Drafting of "Tax return for the sale/purchase/renting/letting of real estate" for tax office DURS;
- Keeping the original contracts and other original documents until the conclusion of the business;
- Following up the execution of a Sale contract;
- Drafting a proposal for entry of ownership right
- Cooperation in the handing over of the property and drafting of the minutes;
1. in letting/renting of a real estate:
- Drawing a contract on Commissioning a Real Estate;
- Informing the Principal and third party of the market situation relevant for determination of rent, regulations relevant for drawing a contract on Commissioning a Real Estate Agent and client's tax obligations;
- Establishing legal state of a real estate by obtaining relevant documentation (Land Registry extract), contracts (if the real estate has not yet been entered into the Land Registry) and similar;
- Viewing of real estate after the signing of the Contract on Commissioning a Real Estate Agent;
- Advertising the letting/renting of a real estate in media and in other ways and to the extend determined by the agent;
- Informing the Principal of the real estate and organizing contacts with third party;
- Presence at viewing of real estate by the Principal;
- Establishing the actual state of a real estate;
- Informing the Principal of the established legal and actual state of a real estate and reliable warning of the established faults and defects;
- Cooperation in negotiations for the business in hand;
- Drafting of a contract by a university graduated lawyer;
- Written warnings, notices, confirmations;
- Telephone communications with clients.
If the Principal pays due commission in time the Agent shall offer the following services free of charge:
- Handing over of a real estate and drafting of minutes;
Should the Agent, at the explicit request of a Commissioner/Principal, not perform any of the listed services, the Commissioner/Principal is not entitled to a reduction of commission.
In the buying or selling the real estate the agency commission is 4% of the contractual price of the subject real estate. The commission determined in Article 3 of the Contract on Commissioning a Real Estate Agent already considers the fact that the Agent is acting for both parties. The Commissioner shall pay the commission in the amount determined in Article 3 of the Contract on Commissioning a Real Estate Agent.
In Agency for renting and letting of a real estate the agent has the right to a commission in the amount of two monthly rents. IF the agent assists both parties each shall pay half of the commission.
Commission is due to be paid on the day of signing of the contract for which the Agent was commissioned.
OTHER PROVISIONS

For additional payment the agent and the Commissioner/Principal can agree for other services (price elaborate, drafting of contract in a form of a Notary Protocol, obtainment of substitute documents, translations and similar).
If the Commissioner/Principal terminates the Contract on Commissioning Real Estate Agent in ill faith or dishonesty and refuses to conclude a contract with the person introduced to by the Agent under the conditions agreed to by the Contract on Commissioning a Real Estate Agent, he/she/it shall refund the Agent the damages caused and also compensate the Agent's labour which is evident from the current Agent's price list on display at Agent's business premises. Upon a requisition for a preliminary contract, or a final contract the Commissioner is obliged to compensate the cost to the Agent in accordance with Item 2 Article 848 of the Obligatory Act - applies for cases when a legal business is not included.
In the event that a Commissioner/principal is injured during viewing a property or causes damage or injury to others, he/she bears all the responsibility for his/her actions.
These general conditions are an integral part of each Contract on Commissioning Estate Agent drawn by the Commissioner/Principal with the agent.
THE AGENT IS OBLIGED TO PROVE HIS IDENTITY BY SHOWING A REAL ESTATE AGENT INDENTITY CARD AND THE COMMISSIONER/PRINCIPAL IS OBLIGED TO PROVE HIS/HER IDENTITY.
